Judge strikes down NLRB rule

AFEDERAL judge in Washington, D.C., has struck down a new rule by the National Labor Relations Board (NLRB) that was meant to streamline union representation elections. The rule was proposed last year, and among other provisions, it would have prevented employers from filing lawsuits to determine the eligibility of some workers, such as supervisors, who would vote in an election by deferring such challenges until after the unionization vote. By doing so, the rule could have shortened election schedules from a median of 38 days to as few as 10 (Feedstuffs, July 4 and Aug. 1,2011).
