GEOMATICS AND THE LAW: Interpretation of Boundary Descriptions: The Confusion Continues

The disconnect between what prop-erty owners may agree to as a described boundary and what is surveyed on the ground surfaced again in a recent deci-sion~2 in the courts. Petek v. Powell was an endorsement~3 made by the Superior Court of Justice in Ontario at Ottawa. The surprising result of the decision, to any reader, is the need for the court's further involvement at all; the parties had previously started a trial, settled their dispute, and entered into minutes of settlement.~4
