This judgement has been issued following a request for a preliminary ruling and relates to public service contracts for the delivery of meals to patients. The major question is as to whether the contracts concerned can be considered an in-house award and can thus be exempted from Directive 2004/18/EC on the coordination of procedures for the award of public works, public supply contracts and public service contracts (oj 2004 L 134, p. 114) and hence be awarded without a public procurement procedure. In particular, it seeks to know whether the conditions for an in-house award as established by the case law have been fulfilled.
