Locality and village greens

Leeds Group Plc v Leeds City Council [2010] EWHC 810 (Ch) concerns section 22(1 A) of the Commons Registration Act 1965 and the test for an order for an area of land to qualify for registration as a village green. Leeds Group as landowner of land at Yeadon Banks challenged the decision of Leeds City Council to register the land as a village green in line with section 13(b) of the Commons Registration Act 1965. The registration followed a non-statutory inquiry into whether the land fulfilled the conditions under the 1965 Act, as amended by the Countryside and Countryside and Rights of Way Act 2000.
