The background to this application is that the appellants occupy Elvington Airfield which is situated to the south east of York and is surrounded by private residences and farms. An airfield was constructed there in the 1950's for the American Air Force. But military use of the airfield ceased in about 1992, though continued use was made of the airfield by light planes, which are not the subject of any complaint.
