The case of Manchester Ship Canal Company v United Utilities Water plc [2012] EWHC 323 (Ch) concerns the legality of what were claimed to be historic rights of discharge into the Manchester Ship Canal and the Bridgewater Canal. United Utilities Water plc, the defendant in the case is a sewerage undertaker, which discharges water into both canals via numerous outfalls. Two companies as owners or lessees of the canals sought a declaration that United Utilities had no right of discharge through a large number of the outfalls and also sought damages to the extent that present discharges were unlawful.
