The case of Hertfordshire County Council v Veolia Water was covered when heard at first instance in ELM vol. 19 no. 5. This case has now been heard on appeal by the Court of Appeal ([2010] EWCA Civ 887. The case concerns the sum of ?335.31 but an important issue of principle. The Council, a street authority under the New Roads and Street Works Act 1991 received a telephone report that there was a cracked manhole cover in the High Street, Rickmansworth that had caused several people to trip up. It sent workers to the site and they placed two cones and some tape over it. The manhole cover was found to be a potential hazard and, at a later date the respondent water company as owners of the manhole cover repaired it
