In last month's edition of ELM we reported the case of Welwyn Hatfield Council v Secretary of State for Communities and Local Government and Beesley [2010] EWCA Civ 26 in which a certificate of lawful use was granted for a house which Beesley had concealed. However, last month saw another such case, again widely reported in the press in which an owner had concealed the development behind haystacks: see Fidler v Secretary of State for Coomunities and Local Governemnt and Reigate and Banstead Boroush Council [2010] EWHC 143.
