New permitting Regulations

The Environmental Permitting (England and Wales) Regulations 2010 came into force on 6 April 2010. The Regulations are made under powers contained in the Pollution Prevention and Control Act 1999. As indicated in an earlier item (ELM Vol. 19 No. 1) covering the Environmental Permitting (England and Wales) (Amendment No. 2) Regulations 2010. These latest Regulations extend the Environmental Permitting (England and Wales) Regulations 2007. They introduce into the environmental permitting system in England and Wales further integration of existing permitting regimes covering water discharge consenting, groundwater authorisations and radioactive substances regulation authorisations. Provision is also made to include revisions of waste law following the Waste Exemptions Order Review.
