In Barnes and Barnes v Secretary of State for Communities and Local Government [2010] EWHC 1742 (Admin), Judge George Bartlett QC sitting as a deputy judge of the High Court allowed the development, known as Armistead wind farm. Rebecca and Brian Barnes brought an application under section 288 of the Town and Country Planning Act 1990 asking the Court to quash a decision to grant planning permission for the erection of six wind turbines, each likely to be 100 metres tall on a 208 hectare site to the east of Crosslands Farm near Kendal. The couple, whose farm, is only 105 metres away at the closest boundary of the site argued that the development would blight the landscape, cause a noise nuisance, and put their three children at risk.
