HM Advocate v Doonin Plant Ltd [2010] HCJAC 80 is a Scottish case that considers whether a sentence for a waste offence under section 33(l)(c) of the Environmental Protection Act 1990 was too lenient. Doonin Plant, the respondents, pleaded guilty at Glasgow Sheriff Court to a charge under s 33(1 )(c) of the Environmental Protection Act 1990 of harm to the environment and human health. This arose out of unlawful disposal of controlled waste, including paper, wood, plastic, metal, vegetation, polystyrene, insulation material and roofing felt in a manner likely to cause pollution of the environment or harm to human health.
