In Stephen Cooper v Attorney General [2010] EWCA Civ 464 the Court of Appeal considered the liability of the State where errors had been made in the court system in interpreting an EU Directive (in this case Directive 85/337 on Environmental Impact Assessment. The High Court ruling in this case was earlier reported at [2008] EWHC 2178 (Admin) and ELM vol 17 issue 10.
