Safeguarding research participants who lack decision-making capacity

The Code of Practice of the Mental Capacity Act 2005 accepts that research using anonymised data that cannot identify the individual concerned is not intrusive. Research on human tissue held before the Human Tissue Act 2004 came into force, and tissue samples taken from a living person who is not identifiable to the researcher, are also excluded from the MCA's provisions.
