The United States has a well-deserved reputation,both in perception and reality,as the environmental litigation capital of the world.Foreign investors are well accustomed to assessing U.S.environmental litigation risk on a different scale than,for example,comparable risk in Canada or Europe,let alone Latin America,Asia,or Africa.At the same time,environmental litigation is slowly taking root outside the U.S.,whether it be through opposition to oil sands projects in Canada,opposition to forestry projects in Chile,litigation in Ecuador concerning legacy liability from decades-old oil and gas exploration,or environmental litigation in Europe.
