EPA Defends 2013 RFS in U.S. Appeals Circuit Court

The U.S. Environmental Protection Agency (EPA) filed a brief on February 4 in the U.S. Court of Appeals for the District of Columbia Circuit saying that it has broad statutory discretion under the Clean Air Act to determine when to reduce annual renewable fuel volume requirements under the Renewable Fuel Standard (RFS), and that reducing the 2013 requirement would go against Congress’s intention of promoting renewable fuel consumption. “The 2013 RFS rule represents a reasonable exercise of EPA’s broad discretion under the Act, when it reduces the applicable statutory volume of cellulosic biofuel for a given calendar year, to determine whether it should also reduce the statutory volumes of total renewable fuel and advanced biofuel.
