INTRODUCTORY NOTE TO U.S. NINTH CIRCUIT COURT OF APPEALS: CASSIRER V. KINGDOM OF SPAIN

In Cassirerv. Kingdom of Spain & Thyssen-Bornemisza Collection Found. ("Cassirer v. Spain"), the U.S. Court of Appeals for the Ninth Circuit found that an instrumentality of the Spanish government was not entitled to sovereign immunity in a suit for replevin of a painting that was expropriated by the Nazis in the course of World War II, currently owned by and in the possession of a Spanish museum.
