A draft report recommending that gene patents be exempted from infringement liability will again be discussed by a committee that advises the Department of Health and Human Services (HHS) on genetics at the committee's next meeting on February 4 and 5. If HHS adopts the recommendations made in the draft report now being finalized by the Secretary's Advisory Committee on Genes, Society, and Health (SACGHS), researchers and clinics could offer genetic tests on genes that are patented-and holders of these patents would have difficulty suing them.
