There has been growing concern in the industry that adjudication is being hijacked by technical challenges to the enforcement of decisions. The recent case of Kier Regional Ltd vs City and General (Holborn) Ltd shows that the court is keen to address this concern and to get adjudication back on track. City and General employed Kier Regional to refurbish the former patent office library in London. A number of disputes arose, and these were referred to five adjudications. This case concerned Kier's application to the court to enforce one of the decisions, which related to the payment of loss and expense.
