The State of Modern Malicious Software: Foundations of Study on Cyber-Armaments

In this article we propose a new approach to legal study of malware. By analogy with the arms, authors offer a comprehensive approach that includes not only the study of malicious programs themselves, but also of their use for criminal purposes and in order to combat crime, their impact on society and law-abiding citizens, on illegal behavior of organizations, individuals and social groups. We highlight the main types of damage that may be caused by such software and proposes a typology of malware based on them. Authors suggest that we need to distinguish common malware and special purpose software used by law enforcement, counter-intelligence and armed forces.
