The Court of Appeal for British Columbia inCanada has decided against Rio Tinto Alcan(RTA) in a dispute with local tribes over thehydroelectric dam powering the company’sKitimat aluminium smelter in British Columbia.The court ruled that the Saik’uz andStellat’en First Nations can pursue claims thatRTA’s diversion of high volumes of water fromthe Nechako River to its smelter in Kitimat isadversely affecting the river’s ecosystem andharming the livelihood of the tribes.
