Court to review damages in Adamo v Microsoft

A Californian district court has been told to reconsider the damages Microsoft must pay an inventor for infringing his software patent in several versions of the Microsoft Office Suite.Carlos Armando Amado is looking for damages and future royalties to be increased to US2 whereas Microsoft has asked for damages to be held at 4 cents per infringing suite sold.The district court proposed 12 cents,which was thrown out by the Court of Appeals because it was not explained how the level of damages was determined.The Court of Appeals has not given an opinion on the damages rate but said logically it should be between 4 cents and US2.
