Latest ITC Finding Of Injury Offers Few Clues On Other Pending Cases

The International Trade Commission on June 22 found that unfairly priced and subsidized cold-rolled steel exports from China and Japan harmed the U.S. steel industry, but its determination gave no indication how the commission will vote on a second part of the case involving exports of cold-rolled steel from Brazil, India, Korea, Russia and the United Kingdom, according to industry sources. Industry sources are watching to see if the ITC indicates whether it will cumulate all of the involved exporters in the second part of the case, making it easier to prove injury or threat of injury to the U.S. steel industry. In addition, lawmakers want to see how the ITC is applying the injury-related aspects of the Leveling the Playing Field Act, including a provision that says ITC cannot refuse an injury finding solely because a company is still profitable.
