Guidelines, Principles, Standards, and the Courts: Why Can't They All Just Get Along?

McDaniel, Kepes, and Banks (2011) sum-marize the last 3 decades of research literature on the science and practice of personnel selection and identify some inconsistencies between contemporary per-spectives and the requirements of the Uni-form Guidelines on Employee Selection Procedures (Equal Opportunity Employ-ment Commission, Civil Service Commission, Department of Labor, & Department of Justice, 1978). We certainly think that a Uniform Guidelines review is warranted. Many criticisms have been published before (e.g., Guion, 1998; Jeanneret, 2005; Landy, 1986), and likely there are intuitive reasons why the call for review has previously been ignored. There are reasons to think that a review may actually be possible today. However, it is unclear whether a full scale revision to the Uniform Guidelines is the "best" solution or whether such a revision would even be possible. This article provides some context for potential regulatory change and considers some of the options regarding the fate of the Uniform Guidelines.
