Unfortunately, when it comes to enforcement, we sometimes discover that the IP has lapsed, or through misuse or non-use, cannot be enforced. Additionally, IP protection and maintenance is another cost on business, so we also discuss the following ways to minimise the ongoing costs. To recap previous articles, here is a list of the various forms of IP: Trade Marks, Designs, Patents, Copyright, Confidential Information: a right that protects valuable or sensitive secret information such as trade secrets, business secrets, personal or professional information. This right can exist indefinitely, as long as the information is not in the public domain and the obligation for secrecy continues. Protection is best obtained by physical barriers and contractual promises.
