As environmental issues become increasingly prominent, this has threatened the survival and development of humankind. In the long-term governance of China's environmental problems, the positioning of environmental administrative power is unclear, leading to the misplacement of environmental administrative power. Based on this, this paper discusses the origin of environmental administrative power and the status quo of legislation of environmental administrative power in China, and on this basis, puts forward some suggestions for the correction of the misplacement of environmental administrative power in China. The paper sorts out and analyses the reasons that affect the strict environmental law enforcement, and finds out the structural problems in the allocation of environmental administrative power according to the future development of environmental law enforcement supervision, so as to provide realistic basis and theoretical support for the rational allocation of environmental administrative power and strengthening environmental law enforcement supervision.
