According the indictment, Flaherty, and her husband Robert (now deceased), had managed Phoenix Metals USA II. Gardiner is identified as a company shareholder. The Flahertys obtained refining equipment and a mill site claim on public land near Searchlight, Nevada, and they called the site the Black Mountain Refinery. The indictment states the trio fraudulently promoted their company and sold stock in Phoenix Metals. The company was traded on the Over-The-Counter Bulletin Board under the symbol PMTU.
