BETTER SAFE THAN SORRY: AROLOGIES, LIABILITY AND THE MADIA

This paper was written following the hypothetical debate undertaken at the 24th Annual Conference of the Australian Mining and Petroleum Law Association on 29 July 2000 and a subsequent paper prepared by Stephen Walsh QC (one of the panellists in the debate) entitled "The Role of an Apology in Crisis Management".This paper looks at other aspects of apologies, the interrelationship between statements made in circumstances such as that encapsulated in the hypothetical debate and the manner in which those statements receive subsequent publicity.As the factual background of the hypothetical is set out in Stephen Walsh '5 paper, it is not reproduced here.
