Section 63N of the Mining Act 1971 (SA) (the Act) allows the Environment, Resources and Development Court (ERD Court) to authorise mining operations without there being an agreement with native title parties. A recent decision of the Full Court of the Supreme Court of South Australia has determined that an applicant for such an order needs to have applied for, or obtained, a production tenement before it has standing to make such an application.
