摘要

In 1995, the Bardi and Jawi people lodged an application with the National Native Title Tribunal for a native title determination over the Dampier Peninsula and surrounding offshore areas. The determination of the primary judge of the Federal Court was that native title rights and interests existed only in parts of the claim area where: ?there were exclusive native title rights in respect of the mainland area occupied by the Bardi people;the rights in respect of the intertidal zone, reefs and islets were non-exclusive; and ?there were no native title rights and interests over the part of the claim area which the Jawipeople had occupied at settlement.The Bardi and Jawi appealed the determination made by the Federal Court in 2005.
