The top patent appeals court has sent a suit against Amazon.com Inc. to Colorado after finding a patent owner's addition of a defendant was probably just a ruse to keep the suit in Texas. In re Amazon.com, Inc., 2022 WL 17688072 (Fed. Cir. 2022). The U.S. Court of Appeals for the Federal Circuit included a warning about "venue manipulation" in its December 15 order directing U.S. District Judge Alan D. Albright of the Western District of Texas to honor Amazon's transfer request. Flygrip Inc., which holds a patent for a smartphone grip case, must sever its claims against San Antonio-based Coghlan Family Enterprises LLC and transfer its claims against Amazon to the U.S. District Court for the District of Colorado, the Federal Circuit said.
