The new term for the US Supreme Court, which opened on Monday, could again carry signiocant impacts for energy policy in the wake of its landmark ruling in West Virginia v. EPA from last term. In that case, the court’s 6-3 ruling effectively limited the tools the federal government can use to curb power sector emissions and stands to loom large over Biden’s energy agenda going forward. The court’s October 2022 term runs through Jun. 26 and could end up populated with cases that challenge Biden's energy and climate regulations, such as the administration’s 2021 clean car regulations for model years through 2026.
