The Information Commissioner's Office (ICO) is consulting on draft guidance to replace part 4 of its employment code of practice, which covers information about workers' health1. Compared with the current code, the draft includes significantly more guidance relevant to the provision of OH services and the confidentiality of OH records. The consultation on workers' health information follows one on monitoring at work, and is part of an ongoing project to replace the current ICO employment code of practice with guidance on the UK General Data Protection Regulation (UK GDPR) and Data Protection Act 2018 (DPA 2018). The existing code was published in 20112, but was not updated when the DPA 2018 became law. Part 4 of the code was supported by supplementary guidance3 and a 'quick guide'4. The ICO says it wants to replace all three documents with 'a new, more user-friendly online resource with topic-specific areas'.
