One of the most controversial amendments introduced by the UK's Building Safety Act 2022, is the retrospective change to limitation periods for claims under the Defective Premises Act 1972 (the DPA). This has a significant impact for contractors involved in, or who have previously been involved with, the construction of residential developments in England & Wales. The DPA places an obligation on those who carry out work for or in connection with a dwelling to do so in a workmanlike manner, using proper materials so that, when completed, the dwelling is fit for habitation.
