Prosecutions round-up: endangering the public

In this feature, we look at four prosecutions arising from work activities that endangered members of the public. Three of the cases followed fatal incidents in which: an 11-month-old child choked on a piece of mango in a nursery; a care home resident choked on a piece of doughnut; and a falling oak bough struck a man who was walking his dog. All three cases were prosecuted under s.3(l) of the HSW Act in that the offender's conduct of its undertaking exposed people not in its employment to risks to their safety (s.3(1) of the HSW Act). The fourth case involved road repairs that exposed motorists and pedestrians to risks. The fines imposed in the four cases ranged from ￡800,000 to ￡101,000
