DME continues to lack love from Rochester Coaltion; shocked?

The Rochester Coalition has filed comments alleging that the Federal Railroad Administration has erred in adopting the environmental impact statement prepared by the Surface Transportation Board concerning the Dakota, Minnesota & Eastern Railroad's coal train expansion project out of the Powder River Basin. The pesky coalition also filed comments stating that the STB's final EIS is factually stale according to FRA's own National Environmental Policy Act procedures. "The FRA is relying on a dated, insufficient EIS that the Department of Transportation's General Counsel's Office has indicated is problematic," said Steve Ryan of Manatt, Phelps & Phillips LLP and legal counsel for the Rochester Coalition. "When considering granting a 2.3 billion dollars taxpayer-funded loan - the largest federal loan to a private company in U.S. history - the federal government needs to use up-to-date information."
