The Supreme Court recently made a radical change in the law on resale price-fixing. For nearly a hundred years it had been an automatic violation of the antitrust laws for a manufacturer to agree with a reseller on the retail price. That has now changed. In 1911 the Supreme Court prevented Dr. Miles Medical Co. from controlling retail prices for its patent medicines. The court ruled that manufacturers violate antitrust laws whenever they agree with their retailers on resale prices. It didn't matter why they agreed on the price or whether the price was reasonable. It didn't matter whether the manufac-turer was a major player or a new entrant. An agreement on resale price always violated the antitrust laws.
