College Reviews Website Subdomains With School Names Don't Infringe School Marks

A college reviews website operator's use of educational institutions' names as subdomains did not infringe the schools' trademarks, the U.S. District Court for the Southern District of New York held March 29 (Boarding School Review L.L.C. v. Delta Career Education Corp., S.D.N.Y., No. 1:11-cv-08921-DAB, 3/29/13). The court held that the website operator's use of the marks in subdomains, as well as on webpages containing information about the mark holders' educational institutions, was unlikely to cause confusion among consumers.
