Massey Shareholder Lawsuit May Proceed, But New Counts Not Added

A man who has sued Massey Energy Company, alleging corporate mismanagement and numerous violations of safety regulations, failed in his effort to add several new counts to a federal lawsuit on September 30, 2009. However the federal court denied the company's motion to dismiss the original lawsuit, clearing the way for discovery and a possible trial. Vernon Mercier is a shareholder of Massey Energy and he filed a derivative lawsuit in September 2007 in U.S. District Court for the Southern District of West Virginia.
