The Nairobi Convention: Unanswered questions

The Nairobi Convention on the removal of wrecks came in to force in April, and gives flag states a legal basis for removal of shipwrecks that might affect adversely the safety of lives, goods and property at sea, as well as the environment. While the convention has been widely lauded, there remain unanswered questions about its applicability in EEZs. "Some countries claim this water as theirs even if it is miles off their coastlines," explains Nick White, LOC director. The convention not only makes owners financially liable but requires them to take out insurance or provide other financial security to cover the costs of wreck removal.
