The US Court of Appeals for the Ninth Circuit on Monday (Aug. 17) denied a request by pesticide manufacturers to reconsider an order that vacated EPA's registrations of their dicamba herbicides. The decision by the full court to reject the bid for en banc review leaves in place a June 3 order by a three-judge panel. That order required EPA to vacate the registrations of the dicamba pesticides, which were approved in 2018 for over-the-top (OTT) use on cotton and soybeans genetically engineered to tolerate the herbicide.
