Trump Administration Moves to Implement Updated NEPA Overhaul

The outgoing administration is quickly moving to update the National Environmental Policy Act (NEPA) before leaving office in January. The Department of Transportation (DOT) issued their proposed regulations on November 23 while the Environmental Protection Agency (EPA) has sent their proposed rule to the Office of Information and Regulatory Affairs (OIRA) at the Office of Management and Budget (OMB) for review. In July, the Council of Environmental Quality (CEQ) issued newly updated regulations modernizing and streamlining NEPA procedures. While the CEQ regulations went into effect on September 15, 2020, all Federal agencies were directed to align their environmental review processes to the new rules by fall 2021.
