Federal Circuit Rejects State Law Challenge to Agreement for Decommissioning of OCS Wells In Taylor Energy Co. v. United States, 975 F.3d 1303 (Fed. Cir. 2020), the U.S. Court of Appeals for the Federal Circuit rejected Taylor Energy Company LLC's (Taylor) claims under Louisiana law for breach of a trust agreement with the United States that provided financial security for decommissioning work on oil and gas wells on the Outer Continental Shelf (OCS) and other claims. The court of appeals dismissed Taylor's claims because federal, rather than state, law governed them.
