OCC Adopts New Produced Water Rules To align existing rules governing produced water with New Mexico's new 2019 Produced Water Act, N.M. Stat. Ann. §§ 70-13 -1 to -5, on September 3,2020, the New Mexico Oil Conservation Commission (OCC) adopted new rules concerning reporting requirements for produced water. See OCC Order No. R-21343-A (Sept. 3, 2020). The rules implement additional reporting requirements to better track the types and volumes of water used in the oil and gas industry. Although criticized for being bare bones, the rules encourage oil and gas producers to reuse produced water when possible rather than relying on freshwater sources for oil and gas drilling and completion phases.
