Good-Faith Negotiations Standard for Condemnation of Lands Requires Specificity of Property Description EOG Resources, Inc. v. Floyd C. Reno & Sons, Inc., 2020 WY 95, 468 P.3d 667, an appeal from the District Court of Campbell County, involved a condemnation proceeding brought by EOG Resources, Inc. (EOG) after an unsuccessful effort to obtain an amended surface use agreement with Floyd C. Reno & Sons, Inc. (Reno). Reno claimed EOG's good-faith negotiations under Wyoming's condemnation statute, Wyo. Stat. Ann. § 1-26-509(a), were inadequate because, among other reasons, the property EOG sought to condemn bore little resemblance to the subject of EOG's and Reno's negotiations. The district court agreed, and EOG appealed.
