T he owners of Laclede Inc., manu- facturer of Salivea OTC dry mouth products, didn’t agree to a lifetime banishment from competing in the cat- egory when they sold the Biotene brand to GlaxoSmithKline PLC, says a federal judge. Laclede can continue marketing its Salivea dry mouth toothpaste, mouth- wash and oral spray with GSK’s trademark infringement and unfair competition complaint pending, although it will have to stop using the Biotene logo in advertis- ing, Judge Jesse Furman ruled recently in US District Court for Southern New York.
