A case going through the EU courts will raise "complex untested questions" on the publication of confidential data in assessment reports of agrochemicals, says a European Court of Justice (ECJ) judge. The case was brought by Luxembourg Industries in late 2013 concerning its fungicide, potassium phosphonate, which gained EU approval as a new active ingredient that year {Agrow No 663, p 14). The company is challenging a European Commission decision to reject its request for certain information to be removed from the peer review report and final addendum produced by the European Food Safety Authority (EFSA). The issue concerns differing interpretations of the extent of information that can be considered "confidential".
