On December 10,2019, the Colorado Department of Natural Resources' Division of Reclamation, Mining and Safety (DRMS) issued a notice of proposed rulemaking regarding proposed revisions to Colorado's coal mining regulations. See Regulations for Coal Mining, 42 Colo. Reg. 23 (proposed Dec. 10, 2019) (to be codified at 2 Colo. Code Regs. § 407-2). The regulatory revisions are being prepared, in part, to implement changes based on a formal program amendment to Colorado's coal program, which was approved by the U.S. Department of the Interior's Office of Surface Mining Reclamation and Enforcement and went into effect on October 3,2019.
