NOI Seeks Input on Changing Oil Pipeline Rate Screen to Percentage Test

Instead of treating oil pipeline rate protests and complaints differently in an initial screen of what constitutes excessive rates, FERC is seeking comment through a Notice of Inquiry (NOI) on moving to a single test. The Percentage Comparison test, currently used for protests of oil pipeline indexed rates increases, measures revenues and costs from Form 6 data to see if there is more than a 10% differential between the index rate increase and the change in the prior two years’ total cost-of- service data from the Form 6 page 700 information. The NOI requests comments on using that test to replace the Substantially Exacerbate test, which is currently used for complaints on oil pipeline rates.
