FERC Reconsiders Subpoena Request by Energy Transfer Partners; McGraw-Hill must Provide More Data

The Commission granted, in part, a request for rehearing by Energy Transfer Partners LP (ETP) (IN06-3) regarding its subpoena to compel the McGraw-Hill Companies to provide certain trading data. The latest order, issued September 4, directs McGraw-Hill to provide additional data within 15 days. The two parties have been engaged in a procedural tug-of-war ever since FERC issued an order in July 2007 requiring ETP to show cause why it had not violated Market Behavior Rule 2 by manipulating wholesale gas prices at the Houston Ship Channel (HSC) and other Texas locations by suppressing prices to benefit its financial and physical positions. ETP has been seeking data on the compilation of Inside FERC gas price indices on grounds that the information goes to the core of the allegations contained in the OSC.
