Powhatan Energy Fund Files Appeal of District Court Order in Fourth Circuit

Powhatan Energy Fund LLC filed an appeal October 4, with the U.S. Court of Appeals for the Fourth Circuit of the U.S. District Court for the Eastern District of Virginia’s decision denying Powhatan’s motion to dismiss the Commission’s action to enforce its penalty order. The district court also issued an order in the case, which provided that Powhatan could appeal the court’s order, which would ordinarily not be appealable (FERC v. Powhatan Energy Fund LLC).
